Los Angeles Team Secures Summary Adjudication for Vehicle Manufacturer in Song-Beverly Consumer Warranty Lawsuit

Los Angeles, Calif. (July 8, 2024) - Los Angeles Partner Judd Gilefsky and Associate Jeck Dizon recently obtained summary adjudication for a vehicle manufacturer in a Song-Beverly Consumer Warranty Act lawsuit brought by a plaintiff who alleged defects to his vehicle.

The plaintiff alleged the vehicle manufacturer refused to offer to repurchase or replace his vehicle when his vehicle had defects to the engine that the manufacturer could not repair after a reasonable number of repair attempts. Yet, through their motion for summary adjudication and oral argument, the team was able to argue that the vehicle manufacturer actually did promptly offer to repurchase the plaintiff’s vehicle, which led to the court granting the vehicle manufacturer’s motion on the plaintiff’s breach of express warranty claim.
