Partner Kip Adams Argues Before Eleventh Circuit Court of Appeals on Complex OSHA Matter

On March 26, Boston Partner Kip Adams appeared before the Eleventh Circuit Court of Appeals in downtown Atlanta on behalf of a firm client concerning a complex OSHA law issue.  

Atlanta, Ga. (March 28, 2025) - On March 26, Boston Partner Kip Adams appeared before the Eleventh Circuit Court of Appeals in downtown Atlanta on behalf of a firm client concerning a complex OSHA law issue.  

Mr. Adams presented oral argument before a three-judge panel challenging a lower court and OSHA Review Commission finding that his client should be considered a “single-employer” with its affiliated company under OSHA law. He also coordinated with co-counsel over several months to ensure that his arguments supported a separate but related appeal to the Eleventh Circuit to argue that OSHA had failed to demonstrate in the lower court proceedings that its proposed abatements to address the hazard of workplace violence were economically feasible.  

This coordinated appellate effort appears to have been successful, as the Eleventh Circuit stated from the bench at the conclusion of oral argument that it was intending to issue an order reversing and remanding at least some of prior adverse rulings back to the lower court for review.  Special recognition is owed to Partners Patricia Gary (Boston), Timothy Brown (Boston), and Caroline Sand (Miami) who helped analyze the issues, prepare the appellate briefing, and satisfy the Eleventh Circuit filing, service, and disclosure requirements.
