Timothy Swickard is a partner in the Sacramento office of Lewis Brisbois. As the vice-chair of the Environmental, Land Use & Natural Resource practice, he serves his clients in all aspects of his nationwide practice of government regulatory compliance in the areas of environmental, energy, transportation, and land use. Mr. Swickard was the former director and chief counsel for Cal/EPA Department of Toxic Substances Control under Governor Arnold Schwarzenegger. His law practice focuses on federal, state, and local government relations for permitting and licensure, regulatory due diligence and compliance, as well as enforcement defense and litigation regarding government compliance and enforcement actions.
Mr. Swickard’s undergraduate major at the University of California, Davis was biochemistry, providing him with an extensive, substantive hard science and chemistry background to apply to the technical environmental, engineering, laboratory analysis, and consumer product issues that arise in his practice.
Mr. Swickard recently served as the lead real estate transactional and environmental counsel for the $285 million sale of the AAA Asphalt Plant to the City of Irvine, and he provided government regulatory compliance counsel to FedEx Ground and Knight-Swift Trucking. Mr. Swickard also provided enforcement defense counsel for dual Notices of Violation from the U.S. Department of Energy and the California Energy Commission for a U.S. Ceiling fan importer from China — who was faced initially with over $27 million of fines and penalties. Additionally, Mr. Swickard secured all of the Permits and the Power Purchase Contract for a 1 MW geothermal electrical generation plant.
Before commencing his legal practice, Mr. Swickard served as a judicial extern for the Honorable Edward C. Reed Jr., Senior Judge, United States District Court, District of Nevada, and for the Honorable Gregory G. Hollows, Chief Magistrate Judge, United States District Court, E.D. Cal.
