Lauderdale Partner Katina Hardee, with assistance from St. Louis Associate Aidan Hayward, recently secured summary judgment in the Circuit Court for Palm Beach County, Florida on behalf of two clients in a construction loan fraud case. The Court accurately determined that neither of the LBBS clients owed a duty to the plaintiffs to prevent the alleged fraud from occurring.

Madison County Partners Nick Martin and Jarred Reed recently secured summary judgment in the U.S. District Court for the Central District of Illinois on behalf of a major retailer. The court determined that the store neither created the alleged hazardous condition nor had notice of its existence.

In a significant opinion issued on March 31, 2025, the U.S. Court of Appeals for the Second Circuit held that the plaintiff’s injuries, which included shoulder tears with arthroscopic surgery following a rear-end collision accident and lumbar spine herniations with injections, could not be considered “serious injuries” as defined by New York Insurance Law §5102(d) (the “threshold law”).

Los Angeles Trial Partner Dana Alden Fox has been appointed to the Budget & Finance Committee of the International Academy of Trial Lawyers (IATL). On March 27, 2025, a Providence County Superior Court jury returned a unanimous defense verdict for Kirkbrae Country Club after a four-day trial presided over by the Honorable Associate Justice Joseph A. Montalbano. Providence Partner Monica R. Nelson and Associate Nicole L. Andrescavage represented Kirkbrae at trial after five years of extensive discovery and pre-trial motion practice.
