Sean Higgins is an appellate specialist and partner at Lewis Brisbois. In addition to his appellate practice, Sean represents clients at the trial court level in business litigation, toxic tort defense, and international arbitrations. Sean is admitted to practice in Texas, California, and Michigan and appears regularly before courts in all three states.

Appellate

Sean is certified in civil appellate law by the Texas Board of Legal Specialization—a distinction held by only a few hundred Texas  attorneys. Sean argues regularly before the Texas Supreme Court, the United States Court of Appeals for the Fifth Circuit, and in each of Texas’ courts of appeals. Sean also has also represented clients before the United States Supreme Court and the United States Courts of Appeals for the Sixth, Eighth, Ninth, Tenth and Eleventh Circuits. Clients value Sean’s ability to craft winning legal arguments that are concise and cut to the heart of the question posed. Clients frequently engage Sean to participate as embedded appellate and advanced motion counsel.

Toxic tort, asbestos, and environmental litigation

Sean represents clients in asbestos, cosmetic talc, and other toxic tort litigation, and serves as national counsel for a client in cosmetic talc cases. He has tried several asbestos cases to verdict, and has won reversals of substantial verdicts in asbestos cases. Sean has also developed and administered innovative national motion strategies for clients in asbestos cases.

Business litigation

Sean represents clients in commercial and intellectual property disputes, and in arbitrations under both UNCITRAL and AAA rules. He has tried cases to verdict in these areas and has won reversal of significant adverse judgments.
