FMCSA Voids 15,225 Medical Examiner Certificates

Pittsburgh, Pa. (May 2025) - On April 11, 2025, the U.S. Department of Transportation’s (USDOT) Federal Motor Carrier Safety Administration (FMCSA) announced its decision to issue Notices of Proposed Removal from the National Registry of Medical Examiners (National Registry) for failure to adequately perform USDOT physical qualification examinations of interstate commercial motor vehicle operators in accordance with the Federal Motor Carrier Safety Regulations.

The FMCSA found two Houston-area doctors non-compliant with physical qualification examination regulations for commercial motor vehicle drivers, voiding certificates issued by the examiners.

FMCSA Chief Counsel Jesse Elison stated:

Removing non-compliant medical examiners from the National Registry is a necessary step to maintain the integrity of the medical certification process and ensure that only qualified, properly trained professionals are certifying the physical qualifications of commercial motor vehicle drivers.

After identifying concerns about the high volume of physical qualification examinations conducted by Drs. Jenny Le (National Registry No. 4762579227), Doctor of Chiropractic, and Dustin Mai (National Registry No. 7120983977), Doctor of Chiropractic, the FMCSA referred the matter to the USDOT Office of Inspector General. The USDOT Office of Inspector General then collaborated with the FBI and the U.S. Department of Homeland Security to investigate the examiners' actions. FMCSA subsequently determined that Dr. Le and Dr. Mai failed to correctly apply required standards in determining that drivers are physically qualified to operate a commercial motor vehicle.

Accordingly, on April 10, 2025, FMCSA voided over 15,000 unexpired Medical Examiner’s Certificates issued by Dr. Le and Dr. Mai between March 2023 and March 2025 – an action that affected 15,225 commercial motor vehicle drivers. While this action does not immediately impact a driver’s ability to continue operating a CMV, drivers who received their MECs from Dr. Le or Dr. Mai must obtain a new certificate by May 10, 2025, from one of more than 38,000 active medical examiners listed on the National Registry.

If a driver fails to obtain a new certificate by the identified date, the driver’s respective state drivers licensing agency (SDLA) will initiate procedures to downgrade the driver’s CDL.
