Francis Pileggi Speaks With Law360 About Delaware’s Future as “Corporate Charter Hub”

Wilmington, Del. (January 7, 2026) - Wilmington Managing Partner Francis G.X. Pileggi recently spoke with Law360 for an article discussing trends that attorneys expect to see in Delaware cases and corporate law during 2026. As the article titled “Top Delaware Chancery Cases And Trends To Watch In 2026” observes, Delaware’s laws and business courts are entering the new year “wrapped in . . . controversy and high-level litigation, with the state's future as the nation's premier corporate charter hub under continued critical attention.”

Mr. Pileggi offered his perspective on whether corporations were likely to begin reincorporating outside of Delaware due to their financial, corporate, and investors’ interests – a potential future trend often labeled “DExit.” Mr. Pileggi told Law360, "I have been following Delaware law for almost 40 years and to paraphrase Mark Twain, those who predict the decline of Delaware's prominence are engaging in hyperbole . . . There have always been concerns and anxiety, at least over the last four decades, that one or more court decisions or changes” would cause "the end of the Delaware dynasty." He further explained, "If one takes a step back and considers the history of the last few decades . . . the only difference I see is that members of the judiciary, or at least former members, seem to be less hesitant to publicly criticize sitting members of the bench — and members of the bar seem less disinclined to publicly challenge the bona fides of their fellow lawyers."
