Francis Pileggi Speaks with Law360 About Predictions for Delaware Litigation in 2023

Wilmington, Del. (January 9, 2022) - Wilmington Managing Partner Francis G.X. Pileggi was recently interviewed for a Law360 Pulse article, titled, “What Delaware's Legal Leaders Are Focusing On In '23,” which addresses firm leaders’ forecasts for the types of matters that will populate Delaware courts in the year ahead.

In discussing his own practice, Mr. Pileggi told the publication, "From my point of view, I continue to be busier than ever." He further noted that during 2023, he will be focusing on how economic conditions impact litigation. He also noted, however, that large, high-stakes litigation likely will continue regardless of the state of the economy. "Although predictions about future economic conditions, and their impact, can't be guaranteed," Mr. Pileggi said, "most of the high-end corporation litigation that I am familiar with, involving large amounts of money (and other important issues) at stake, will not likely slow down because of what is happening in the economy as a whole."

Mr. Pileggi also told Law360 Pulse that he would be following certain cases during 2023, including a pending post-trial decision in a Chancery Court matter challenging Tesla CEO Elon Musk's compensation, as well as a Ninth Circuit shareholder derivative suit against The Gap. According to Mr. Pileggi, the matter involving The Gap is significant because it relates to the "enforceability of forum selection clauses requiring claims to be brought in Delaware that might otherwise have been brought in federal court.”
