Steven Lee Quoted in Law360 Article About Trump’s Grand Jury Indictment

Atlanta, Ga. (August 3, 2023) – Atlanta Partner Steven H. Lee recently spoke with Law360 about former president Donald Trump being indicted by a grand jury for conspiracy to overturn the results of the 2020 presidential election.  

According to the article, titled “4 Takeaways From Trump's Election-Meddling Indictment,” Mr. Trump has been charged with conspiracy to defraud the United States, obstruction of an official proceeding, and conspiracy against rights. After the election, Mr. Trump is accused of deliberately disregarding the truth and continuing to disseminate claims of widespread voter fraud that impacted the results.  

Law360 spoke to various legal experts, who offered four takeaways from the indictment and suggested that the prosecution will have the challenge to prove beyond a reasonable doubt that the former president had criminal intent behind his efforts to overturn the results of the 2020 election.

The indictment, headed by special prosecutor Jack Smith, included six unnamed co-conspirators who assisted Trump in the alleged plot to overturn the election results ­– four attorneys, a Justice Department official, and a political consultant. 

A former federal prosecutor, Mr. Lee told Law360 even if alleged co-conspirators refuse to cooperate with Mr. Smith in the investigation, their "statements are allowed as an exception to hearsay under the evidence rules, so the government will likely introduce such statements in the government's case in chief anyway."
